This Agreement stipulates the terms of use by Users of the 5element.ua site (hereinafter - the «Site»), as well as its services, and therefore, it is important to understand that the use of the Site, namely:
filling out various forms and applications;
ordering goods, works, services using the services of the site means that you agree to the terms of this Agreement and the rules for using the Site.

1. General conditions
1.1. This Agreement is a public offer (hereinafter - the Agreement).
1.2. In case of access to the services and materials of the Site, the User will be considered to have joined the Agreement.
1.3. The use of materials and services of the Site is regulated by the current legislation of Ukraine.
1.4. The Site Owner (hereinafter - the Administration) unilaterally and at any time has the right to change the terms of this Agreement, services, materials, information, any other data posted on the Site, in particular regarding the price of goods, their availability or absence, other characteristics.
1.4.1. Changes enter into force within three days from the moment the new version of the Agreement is posted on the Website.
1.4.2. If the User disagrees with the changes made to the Agreement, he must refuse access to the Site and stop using its services and materials.
2. Purpose.
2.1. The materials and services of the Site are created and posted by the Administration in order to provide the Users and consumers with information about the subject of the Site Owner’s activities, as well as the goods and services provided by him.
2.2. The site may contain links to other sites. Such links are provided solely for informational purposes, and the passage of such links is the sole discretion of the User. Placement by the Administration on the Site of links to another, external resource does not mean that we fully approve of the positions or ideas expressed there, nor do we guarantee the accuracy of the information posted there.
3. User rights

4. Responsibilities of the User
4.1. The user undertakes not to take actions that may be considered as violating the current legislation of Ukraine and/or the norms of international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead to or may lead to disruption of the normal operation of the Site and its services.
4.2. Users have the right to view and download information and materials from the site only for personal (non-commercial) use. Commercial and/or public use of materials, information, and other data posted on the site, as well as any use of materials, information, and other data of the Site on other sites and/or means of information without the consent of the Administration is prohibited.

5. Liability
5.1. The user is warned that the Site Administration is not responsible for visiting and using external resources, links to which may be contained on the Site.
5.2. In the event that the data posted on the Site do not correspond to reality and the User, without taking measures to verify them, will incur any losses in connection with this, such as losses from loss of profit, losses or losses related to any the content of the Site, copyright registration and information about such registration, goods or services available on or received through external sites or resources or other contacts of the User, which he entered using the information posted on the Site or links to external resources, the Administration is not responsible for such damages.
6. Personal data
6.1. When placing an order on the Site, or when registering using accounts from social networks, or by ticking the appropriate box on the Site before filling in his personal data, the User gives his consent to the Administration for collection and processing (accumulation, storage, adaptation, recovery, use , distribution, depersonalization and destruction) of the data specified by him, such as: surname, first name, patronymic; email address; contact phone number; address; Date and place of birth; ID number; citizenship; availability of benefits; information on registration as an individual entrepreneur; information about marriage; information on income and expenses; phone number; place of work and position; work experience; date and reasons for dismissal from previous jobs; information on receiving pensions; marital status; property status (availability of immovable and/or movable property); place of actual residence; place of residence for state registration; passport data (number, series, by whom and when issued); data on children, including adopted children; other data, in order to ensure the implementation of sales relations, relations in the field of consumer rights protection, in the field of advertising and marketing research, and also gives his consent to the transfer (distribution) of his data to courier organizations, any Banks and/or financial institutions, and other third parties (without limitation) at the discretion of the administration.
6.2. The source of personal data collection is information directly and voluntarily provided by the User.
6.3. The provisions of this section are valid without time limit.
7. Other conditions
7.1. All possible disputes and disputes related to this Agreement or its implementation shall be resolved in accordance with the current legislation of Ukraine.
7.2. Nothing in the Agreement can be understood as the establishment between the User and the Site Administration of an agency relationship, a partnership relationship, a joint activity relationship, a personal employment relationship, or any other relationship not expressly provided for in the Agreement.
7.3. Recognition by a court of any provision of the Agreement as invalid or unenforceable does not entail the invalidation of other provisions of the Agreement.
7.4. Inaction on the part of the Site Administration in the event of a violation by any of the Users of the provisions of the Agreement does not deprive the Site Administration of the right to take appropriate actions later to protect its interests and protect copyrights on the Site’s materials, which are protected in accordance with the law.
8. The user confirms that he is familiar with all provisions set forth in this Agreement, understands their meaning and unconditionally accepts them.
